An Auburn man is being sent to prison after police found cocaine in his home and an officer was injured months later while trying to catch him as he ran away.
Seraphin Moniz, 31, was before Judge Thomas Leone in Cayuga County Court Thursday morning. Moniz was sentenced to seven years in state prison followed by three years of post-release supervision for third-degree criminal possession of a controlled substance (a Class B felony).
The defendant, who was charged after the Finger Lakes Drug Task Force discovered six ounces of cocaine at his residence in a search in May, was also sentenced to two to four years in prison for second-degree attempted assault (a class E felony) and 2.5 years followed by two years of post-release supervision for a parole violation for third-degree attempted criminal possession of a controlled substance (a Class C felony). Those sentences will be served concurrently.聽
Moniz' attorney, Michael Spano, said in court that his client has "a long history of drug abuse."聽
Leone recommended that when Moniz is within three years of his release from prison, he become eligible for a drug recovery program.
After the task force executed a search warrant in the spring, a Cayuga County grand jury issued a sealed indictment against Moniz in September and he was arrested by the Auburn Police Department in October.聽
When he tried to run from police, an officer suffered cuts to his right arm and knee. Spano said after the sentencing that Moniz did not intend to cause the officer's injury. When Moniz pleaded guilty in December, his original charge of second-degree assault (a class D felony) was reduced to the attempted assault count.聽聽
