An Auburn man facing a murder charge for a fatal stabbing in Syracuse will appear in court this week to determine if statements he made to police were voluntary.聽
Tyler Kilmer, 30, will appear at a suppression hearing in Onondaga County Court on Friday,聽Onondaga County Senior Assistant District Attorney Anthony Copani told 水果派AV in an email.
Kilmer was indicted for second-degree murder in December following the stabbing death of DeVonte Crosby, 31, of Syracuse.
Kilmer was initially charged with first-degree manslaughter before the indictment, but Copani said he asked the grand jury to consider the murder charge based on the evidence. Kilmer was also charged with third-degree criminal possession of a weapon, which was changed with the indictment to fourth-degree criminal possession of a weapon.
础蝉听previously reported聽by 水果派AV, Crosby was found by Syracuse police with a stab wound in his torso the morning of Nov. 13 at 610 Oswego St. He died at the scene.
A Syracuse police spokesperson 聽that officers, responding to a domestic dispute, spoke with Kilmer twice that morning before Crosby's death. The first time, officers left after speaking to both men and determining the argument between them had cooled off.聽Kilmer was outside, visibly intoxicated and unable to find his car keys.
Police returned to the residence after receiving a report of Kilmer acting erratically outside, the spokesperson continued. Officers demanded he find another place to stay or get a ride home. When no one returned his calls, officers asked him to reserve a room at a hotel and drove him to one on South Salina Street, about three miles away.
Kilmer, however, found his way back to the Oswego Street residence and stabbed Crosby to death, police said.
The spokesperson said the two men knew of each other, but could not confirm how they met or how long they had known each other.聽
Kilmer's attorney, Graeme Spicer, declined comment to 水果派AV.
